Terms of Use

These Terms of Use govern access to and use of the website beta.blacklistpdr.com ("BlacklistPDR", the "platform", "we", "us"). By creating an account or using the platform, you confirm that you have read, understood and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the platform.

1. Who we are

2. What BlacklistPDR is

BlacklistPDR is a private network where PDR (paintless dent repair) technicians share personal opinions and experiences about body shops, brokers, dealerships and other companies that hire them.

  • The platform does not hire, broker or recommend services and does not take part in payments between technicians and companies.
  • The platform does not verify whether the facts described in reviews are true. A company's score is only the average of members' opinions and is not a certification, audit or statement about anyone's integrity.
  • Ratings and comments represent solely the opinion of the person who posted them.

3. Accounts and eligibility

  • You must be 18 or older and work professionally in PDR.
  • Every registration is manually reviewed. We may refuse, suspend or close accounts at our discretion, especially where there are signs of false information or misuse.
  • You agree to provide accurate information and keep it up to date, not to create more than one account, and to keep your password confidential. You are responsible for all activity under your account.

4. Ratings and comments

By posting a rating or comment, you represent and warrant that:

  • you actually worked for the company or had a direct, first-hand experience with it;
  • the content is your honest opinion and the facts you describe are true to the best of your knowledge;
  • you did not receive payment, discounts or any benefit to post it, and you have no conflict of interest (for example, reviewing your own company, a competitor or a former partner);
  • you have the right to post what you are posting.

You may not post:

  • information you know to be false or misleading;
  • personal attacks, threats, hate speech or discrimination;
  • personal data of others, such as home addresses, ID documents, bank details or photos of people without permission;
  • accusations of crimes not supported by facts you can back up;
  • advertising, spam, malicious links or content unrelated to the work experience;
  • content that infringes copyrights, trademarks or other rights.

Each member may give one rating per company (which can be updated later) and post comments.

You are solely responsible for the content you post, including towards the reviewed company and before the courts.

5. Anonymous posting

You may choose to post as "Verified tech" without showing your name. Anonymity applies only to the public: the platform always knows who wrote each piece of content, keeps the access records required by law, and may disclose your information in response to a court order or a lawful request from a competent authority.

Even when posting anonymously, details in your text (dates, amounts, places) may allow someone to infer who you are.

6. Disclaimer regarding user content

Ratings and comments are created by members. BlacklistPDR is not the author of, does not endorse and is not responsible for the opinions posted, and does not guarantee that they are accurate, complete or current.

  • In the United States, the platform acts as a provider of an interactive computer service under Section 230 of the Communications Decency Act (47 U.S.C. § 230), under which a provider is not treated as the publisher or speaker of content provided by others, including when it moderates in good faith.
  • In Brazil, the platform acts as an internet application provider under the Brazilian Internet Civil Framework (Law 12,965/2014). Third-party content may be removed by court order or, where applicable, after notice, in accordance with the law and current case law.

7. Moderation

We may, at any time and without notice, hide or remove content that violates these Terms or the law, and suspend or close accounts. We have no obligation to monitor what is posted, and keeping content online does not mean we agree with it.

8. Reviewed companies: disputes and right of reply

If you represent a reviewed company and believe that content is false, abusive, unlawful or violates these Terms, write to [TO BE DEFINED] including: the page address, the content in question, the reason and a way to contact you. We will review it and reply. We may keep content that expresses a legitimate opinion about a real experience, even if negative. Court orders will be complied with as required by law.

9. License to your content

You keep ownership of what you post. By posting, you grant BlacklistPDR a worldwide, royalty-free, non-exclusive license to host, display, reproduce, translate and organize that content on the platform while it remains published. If you delete your account, your ratings and comments are no longer displayed.

10. Intellectual property and copyright

The BlacklistPDR brand, layout, texts and software belong to [TO BE DEFINED] or its licensors. Copyright infringement notices (including under the Digital Millennium Copyright Act — DMCA, 17 U.S.C. § 512) must be sent to [TO BE DEFINED], identifying the work, the material in question, your contact details and a good-faith statement.

11. Prohibited use of the platform

You may not: copy the database or collect data by automated means (scraping, bots); attempt to bypass security, access other people's accounts or overload the system; use the platform for harassment, extortion or to pressure companies with threats of reviews; resell or share members-only content outside the platform.

12. Limitation of liability

The platform is provided "as is", without warranties of any kind. To the fullest extent permitted by applicable law, BlacklistPDR and [TO BE DEFINED] are not liable for decisions made based on posted content, for indirect damages, lost profits or lost opportunities, or for service interruptions or errors. Nothing in these Terms excludes rights that cannot be waived under the law of your country.

13. Indemnification

You agree to indemnify and hold harmless [TO BE DEFINED], its owners and staff from any claims, actions, damages and expenses (including attorneys' fees) arising from content you post or from your breach of these Terms.

14. Termination

You may delete your account at any time under "My account". We may suspend or close accounts that violate these Terms. Records we are legally required to keep will be retained for the legal period.

15. Changes

We may update these Terms. When a change is material, we will publish a new version and ask you to accept it the next time you sign in.

16. Governing law and venue

These Terms are governed by [TO BE DEFINED]. This does not limit rights guaranteed by mandatory laws of the user's country of residence.
